Ancestral property

My grandfather had made a will (My father, my uncle and my grandmother) for ancestral property before he expired. My uncle who is karta, selling 40% of property and my father is saying nothing. He does whatever my uncle says. Is there something I can do?

A.Hi,
If the concerned property is ancestral property, one cannot make will, since all the co-parceners have equal share in the property. Also, yes you can institute a case, as you are also a co-parcener.

Yes you can institute a case, since you are co-parcener in the said property, moreover, a will cannot be made for the ancestral property, because all the co-parceners have a right of share in the property.
