Tenant not coming back to vacate my house and not paying full rent. Also he is not coming to renew agreement.

My house was rented from past 5 years. there was only first one agreement of 11 month and thereafter there is no agreement. now my tenant has gone away from past 1year leaving all belongings in house. He is not giving full rent as agreed. he is also not coming to renew agreement nor vacating my house. i even don't know where he has gone. he only talk on call rarely and always give false promise to return. but even after one year he has not come. how do i get my house vacated from this tenant. please note we don't have any written agreement nor his id. i also do not know where he is currently living. can i file FIR and open my house breaking lock?

A.Hi,
You can file a suit for eviction after serving him with due notice. The Court can then pass an ex-parte decree, after which the police can remove his belongings from your property.

A.Hi,
You can approach the police and file a complaint to obtain his address. The Magistrate can order the police to break the lock, if he has not been on the premises for a while. You can file a suit for eviction and have the Court pass an ex-parte decree in your favour after providing him with due notice.
