Regarding Divorce from spouse

If I want to discontinue my marital relation after 8 years, because it is very hard for me to survive with my partner now-onward. But she is forcing me to stay with her & kids and refuse to give me Divorce and for that she is defame me in society as like I m Characterless person. Also she had filed complaint of Domestic Violence in Mahila Ayog.. but next not filed complaint under 498 in domestic police station....How can I get Divorce from her if I have already filed Legal Separation against her in family court. I'm performing my all financial responsibility regarding my kids.. I have never refuse for that.. My wife forcing me for the sake of kids come and stay together.. but I dont want to stay with them due to some my personal issue...
A consistent course of conduct inflicting immeasurable mental agony and torture may constitute cruelty. Mental cruelty may consist of verbal abuses and insults by using filthy and abusive language leading to constant disturbance of mental peace of the other party.
The Supreme Court held that any kind of mental cruelty faced by either of the spouses not just the woman but men as well can apply for a divorce on grounds of cruelty. Hence, a man is also entitled to divorce if he is inflicted with any kind of cruelty

You may file a case for divorce stating mental cruelty as a ground of divorce.
