Can we sell our property?

We have a MMRDA flat in Mumbai. Original allotment is on my father's name. He died in Dec 08. We submitted the nomination form and transfered it on my mother's name following year. Now the share certificate is in my mother's name. Can we sell our property and will the new buyer be able to register on his name? This difference of name is an issue or not?

A.Hi,
The title and other deeds to the property must be mutated to your mother's name. This will grant her legal ownership of the property and allow you to proceed with any sale you may wish to undertake.

If the title has been mutated to your mother's name and the records all reflect that she is the legal owner of the property, then you can go ahead with the sale.
