Property drainage issue from neighbours Property drainage issue from neighbours

My neighbour has occupied public drainage area which is behind all the houses and now saying that they have already built the fence, so they won't be removing it and asking us to allow the drainage water inside our property. This is not a clean water, it's a very very unhealthy water from bathroom. How shall I proceed?
