My Grand Father had 30 acres of farm land in Haryana. He had three sons and he had given all his son equal piece of land i.e 10 acres each just for farming ( in Haryana it is called "Gole Khaata" - temporary ownership). My Grand Father have passed now . One of my Uncle have sold all its share to a third party.
Sir now there is an acquisition going to happen by Haryana govt of 6 acres(3 acres of my father + 3 acres of my other uncle) of our total land . Sir , according to rule he will also get the equal amount of part of compensation as of us although he have sold all its 10 acres. How can we get all our compensation without going into his hand?
A.Hi,
File a suit for declaration of title with respect to your 10 acres. Your uncle can do the same for his 10 acres. The third brother cannot claim a part of this as he already sold his share.

No, the other uncle cannot claim a share of the remaining property. He has already disposed of his share. You can file a suit for declaration of title with respect to your share and will then be the sole owners of it.
