My mother had died 10years ago and my father had did remarriage and he got a son and the property was left after my mother died is in the name of my mother then the property got divided into my sister,father, and me. Please tell me that is their any probability that my not real brother will get the property or not?

A.Hi,
A stepson has no right over stepmother's property. But as in this case the share of your mother's property which went to your father, can be inherited by him just as any other child of your father.

A.Hi,
Every legal heir has rights in the properties of the father and hence it is general advise that they will get their respective share in the properties. Therefore even your step brothers have equal right in your father's property.

A.As per Hindu Succession Act a step son cannot take any share from the property belonging to his step mother.
