Hi Sirs/Madams,

For title declaration what are the proofs I need to submit to the court and how long it takes to determine the ownership and complete right of enjoyment under the easements act. Actually, my neighbor is making false allegations, like I occupied part of their land near the border. as it is a village no one is having registrations for the houses. We have built our compound wall almost 17 years ago, but now he came out and spoiling our name and reputation in the village.

Do I really need to wait till I get the title declaration from the court to file a defamation case under 499.

Kindly help us in this matter.

A.Hi,
You can file a separate complaint for defamation under Sections 499 and 500 IPC. For the proof, you will need to provide all documents you have about the land including mother deed, survey reports etc.

A.Hi,
No, you do not need to wait until the decree is passed. File a complaint with the police and claim damages for defamation under Sections 499 and 500 IPC.

A.In your declaration suit itself you can file application for restraining him/X/Y/Z persons from passing defamatory statements in respect of your family and if you get the order in your favour and such person does not adhere to the order than such person can be booked for Contempt of Court. If you don't want to follow this option than you can go and lodge FIR against such person for defamation under Indian Penal Code, 1860 since you have already filed declaration suit in the Court.
