Hi, we have a property in Andhra Pradesh, wherein, my sibling is staying in a home and collecting the rents from tenants since 2020 June. After my father passed away leaving debts to me, few debts I have taken after my father died to arrange rituals and to clear immediate loans. However, still, I have loans. Can we send the eviction notice to the sibling when the property is in legal heir? Can we make sure to vacate her from the home; literally, she occupied the house and threatening tenants and me. If we can evict her then what is the procedure to follow and how much it would cost me if I have to take further steps/action.

A.Hi,
You can send a legal notice to her for evicting from the house if you have proper and reasonable justifications for the same. As she is also a legal heir, she can claim her share in the property. Sending legal notice would be beneficial for you.

A.You can file a suit for partition to your father's properties and an eviction suit to all the tenants
