Out opposition property share holder passed ad interim injunction order without proper information of my father property.. our construction on that property under going. My father had passed planning of the building by panchayat.. without informing by the court they passed that order. The opposition holds only 1/40th share of the property and my father's property share is 1/4th

A.Any person has right to get ad interium injunction without information to the defendants /opposite parties by expart hearing. Now you have to file a petition before the same Court for vacating the ad interium injunction under order 39 rule 4 of CPC. Please contact with a civil lawyer

A.1/40th share or 1/1000000th share have same rights to protect themselves.
you have to vacate injunction to do further construction.

A.if the property is still undivided then the adinterim is absolutely correct. so first file a suit for partition and get your father's share demarcated and then start with your building. meanwhile apply for vacating the order of ad interim injunction. meet any lawyer who will take you through these steps.
