My grandmother's father had been in possession of 1 bigha land whose pattadar/owner was another person belonging to King family and such possession has been recorded in Khatian Register. Later when father of my grandmother died, my grandmother and her only brother were in possession of said land, but still till then concerned land was recorded in the name of said another person belonging to king family and in the khatian Register name of my grandmother's father was mentioned as possessioner. During those period brother of my grandmother sold some parts of the land including to us by executing sale deed, but how it happened I could not understand. Later, may be in the year 1991, sons of my grandmother's  brother upon the consent of the original pattadar i. e. King, mutated their names in Circle Office. Now my question is whether we can claim the said property on behalf of our deceased grandmother? The Big question is said was recorded as possessed land and original pattadar was the King as per Record. Please help.

A.As per the query you will have to to prove that you are the legal Heirs of the so said family and accordingly you can also get your name inserted into the Khata book in the circle office and then you can also ask for your share in that property.

A.Hi,
Such sale deed is invalid as the brother of your grandmother was not in possession of the property. You can reclaim the property from the present holders through filing a suit for reclaiming the property.

A.Hi,
Such sale deed would be invalidated as the brother of your grandmother was not in possession of the land. You will have to file a suit for repossession of the property.
