Tenant issue

I rented my flat for an agreement of 2years. The agreement ended on April, 21. The tenant has not paid rent for 6 months & now wants waiver of 2 months rent or else threatening not to vacate the room. Please suggest what should I do now.

It is wise to take post dated cheque in respect of 2 months rent and get him vacated other wise if matter goes to court it will take 2-3 years time.

A.Hi,
Since the agreement is effectively over, the tenant now is criminally trespassing in your property. You as a landlord have the right to recover your property if any point of agreement has been violated. You can send him a legal notice for recovering your overdue amount. You may also consider filing a police complaint u/S 441 IPC for the offence of criminal trespass.

A.Hi,
As per S. 108 of the Transfer of Property Act, a landlord may recover possession when the tenant has violated the agreement. You can send him a legal notice first but if he is not still not paying you the overdue amount then you can lodge a police complaint u/S 441 of IPC as he is trespassing after the agreement is over.
