My father had bought the land many years ago, he built a house on that land, so my father is the sole owner of the house and the land. After that, he decided to build one more floor in that house, but at that time he took the electric connection of that floor in the name of my Uncle.

Currently, we are living on the first floor for about 8-10 years. And my father wants to sell the house and the land, but the only problem is that the first floor technically belongs to my Uncle while he has not spent any penny on the construction of that floor. So is my father have the legal choice to sell the land and the house totally on his own? or does my Uncle also will share some amount from the selling because he is somehow the owner of the first floor?

I just want to know how much percentage approximately my father has to give him, or does he have the right to stop the selling considering the point that the landowner and the ground floor owner is my father?

What is the process to remove my Uncle's ownership as he had not spent any penny for the construction of the first floor? Is it possible?

A.I guess I answered this but my response in not visible.

Your uncle have no share in property.
No need to give him anything.
It is registered in your father name.
Your uncle can put case just to harass you for litigation but wont get anything.
You better approach electricity office for change of name. You will need registered sale deed copy.

A.See technically or otherwise your uncle doesnot own even a one inch of the property and yes its a mistake that the electricity connection has been taken in his name but that does not establish the fact he owns the floor. Does he have any other proof? Do one thing first of all get the meter disconnected and then provide the connection from the lower floor meter and then try to sale the property of you wish to.
