Court Fees in Suit for Partition
I had filed a Suit for Partition in Delhi for a family house against the other relatives. In the Suit, I and the other Defendants mutually agreed that i will get the entire ground floor of the property and i would not claim any interest in the other floors on the condition that i will have to pay the appropriate court fees. The court then passed an order saying that a Decree of Possession be drawn in my favour after i deposit appropriate court fees.
I want to know how to calculate the court fees in such a case?
A.Hey,
In case of suit for partition as per laws in Delhi, the court fees is decided on market value of the property in subject and percentage amount is different for different cases.

A.Hey,
Court fees depends on state laws, cost of the suit and mense profit if any in the case. In delhi minimum court fees is 1000 rupees for suit of partition but it depends on value of property (market value) in question.

A.Dear Sir,
The court fees can be calculated based on the quantum of the Suit and it also depends upon the State in which the Suit is filed. You should pay court fees immediately in order to obtain possession of the property.

A.Stamp duty or court fee in every court is decided by the state where the court is situated. For the courts in Delhi the Union Territory of Delhi would have decided and published the rates for the court fee. The court fee is dependent on the suit value and is calculate on the basis of the suit value.
