i have bought a apartment by entering in agreement in June 2020 and applied for the transfer of share certificate in my name, however seller did not give us the signed transfer forms. I applied for transfer tot he society with sale deed and paid transfer fees, now society is insisiting on transfer forms duly signed by the seller. Is there alternative procedure to get the transfer in my name without the sellers signature on transfer forms ? Thanks in advance for your help.

You may approach high court for a direction to the society.

A.Hi,
You cannot have the title deed for of your property until the signature of the seller is acquired. You may have to send him a legal notice if he is unwilling to sign or you can also get an affidavit for the sale of property in your name.

A.Hi,
Seller's signature is a mandate in the transfer of property. The seller has failed on his part and you can send him a legal notice to send him the proper documents immediately.

A.What is the reason that the seller is not signing the transferring form? If the reason is is such that it can not be mitigated then get an affidavit done or else must get the signature form the seller in my opinion.
