Sir/Madam, our house was constructed by our grand father in 1960 beside main road i.e., poramboke land in our village at Chittoor district, Andhra pradesh. During road encroachment, our house was partially demolished for road work. Later, it was claimed by local Panchayat that the said land was handed over to Panchayat and there fore, we paid rent for land for several years from 1983. There was dispute with local Panchayat and they denied to receive the rent from 2002. Now, they stated that we have vacate the house and Panchayat will construct commercial complex and give for rent through auction. Due to local villagers politics, there is huge pressure to vacate the house and handover to panchayat. Myself was born in that house and got attachment to it. Please guide me how to make it as patta in my father's name. Is it possible to make it patta. If yes, let me know the procedure.Mean while, how to stop their activities of demolishing of house.

A.Dear Sir,
You may immediately approach Civil Court and get appropriate orders and if required get appointment of Court Commissioner for local inspection under Order 26 Rule 9 of Civil Procedure Code.

In order to get patta contact the revenue department of the state as the panchayat would not provide it to you. if they denies then contact a lawyer and file a petition in the High Court of Andhra Pradesh. It would be suggested to first stop them to demolish the property and have an injunction on construction of comlex.

You could get patta of property from two departments one is panchayat and other one revenue department. You are having a dispute with the panchayat so there a very few chances that they would give patta of the property , so you could approach the revenue department and ask for patta for the said land. If they deny then you could file a petition in the high court of andhra pradesh.

A.See the process to make patta is to apply to either to Panchayat or to the Revenue department but since you are saying that Panchayat itself is asking you to go away from there so they will not make the patta for you. In this case you are left with only one choice now and that is to file a writ petition in Andhra High Court after having discussion with a good high court lawyer in Andhra.
