We have a flat which was purchased by my mother on loan and the loan was then retired well in advance. Subsequently we bought another house and went and stayed there making this house a vacant premises. My father has been having erratically and he has a history of gambling and betting etc. My mother has transferred the flat to me and my sibling via a registered gift deed making us the legal owners of the house. My father is now using that house as his gamble location by inviting his bunch of friends. We want to evict him as he owns nothing in any property we have and we want to know the PROCEDURE and the REPERCUSSIONS of evicting him as he is aged 72 and could be noted as a dependent since he has no earnings of his own. Your kind advise will be of great help. Thanks in advance

A.Dear Sir,
You may approach the police saying that illegal activities being conducted in the said premises by your father. Police may raid such premises and if incremating material or objectionable is seized then your father will be evicted and that premises will be handed over to you since you are the actual owner.

A.I would suggest you not to make this a legal matter by sending notices or anything they he will start using his rights to be maintained as senior citizen and dependent and if goes to court then the court in all likelihood will pass the order is his favour.
So. without going legal try to evict him or find some ways to curtail his gambling practices.

A.Hi,
Because the property is in your name, it is not unlawful to ask your father to relocate and refrain from using it for criminal activities like gambling. You can also seek assistance from old age homes and get your father admitted to one.

A.Hi,
Since the property is in your name therefore it will not be illegal to ask your father to shift and not use the property for illegal activities and gambling. You can also seek the help of old age homes and admit your father in one.
