i am Binoy Mishra, staying in Canada right now , my mom and brother in Udaipur (Rajasthan).we have a propert worth 45-50 lakhs in Varanasi and father passed away a year ago,the KHATAUNI is transferred in mine and my my brother and moms name . my mom got a call from a goon to sell the property in a very lesser price as the goon is freind`s with my uncle`s son (I had 3 uncles(My father and his 3 brothers ) out of which 2 passed away).All of them stay in the same place in varanasi . i want to sell it in a higher price .Please suggest as to what should be the right course of action .

A.Dear Sir,
Please approach Higher Police Officers and get a permanent injunction suit file against them. If police do not agree to register FIR then approach High Court for a direction to register a FIR against such goons.

A.Aap apni property ke sawami hai. Aap apni property ko jis parkat chahe us parkar sale kar sakte. Third person aap ko kisi parkar se nhi rok sakte hai. Agar aap ko koi third person threat kar raha hai to Indian penal code ke anusar crime hai..
Aap us third person and ke khilaf bhi police me complaint kar sakte. Balki aap ko unke khilaf police me complaint file karni chahiye.

A.You have both the Civil and Criminal remedies in this regard so it's up to you which one you will opt to combat that Goon. What the goon is doing has not been specified clearly because a person can express his willingness to purchase another's property at lesser price but if he is trying to pressurize you in some manner which will likely cause injury to your person and/or property,then that will attract penal provisions.

A.Hi,
Do forward the complaint to the higher police official or prefer a private complaint under Sec 200 CrPC to the Judicial Magistrate. You can petition the revenue authorities for surveying your land. You can approach a civil court for injunction and declaration of damages.

A.Hi,
Extortion is defined under Section 383 of the Indian Penal Code. Main ingredients of extortion are: Intentionally putting a person in fear of injury; Dishonestly inducing the person so put him in fear to deliver his property, valuable security to another person. You can file a complaint against the phone number itself at the cyber cell.
