Hi,
My aunt have filed a case against my father for doing false signature for distribution of my grandfather's property as per their will. Which was signed by 2 witnesses.
As per the will 1 portion of property where we stay is given by my grandfather to my father which he wants to register with his name for that joint application was filed with municipality office but now she is denied that the signature was not done by her.
Recently she lost the case with SDM which was done by them against us for property matter.

A.Dear Sir,
First approach High Court to get quash such FIR as it is a family matter and forging of signature cannot be established unless there is expert report. Even then it cannot be established who forged such signature etc.

A.Hi,
If the signature is real, it can be proved in the court as the court seeks help from experts to check its genuinity. Your aunt has to prove that the signature is fake and it is her responsibility as she is the claimant.

A.Hi,
If the signature is real, there is nothing to worry. There are experts who can find out whether the signature is real or not, so if there is such an argument made in court, the court may examine the signature with the help of experts.

A.Agar aap ke grandfather ne vashiyat ki hai tab aap ko koi problems nhi hogi. Agar aap ke dawra kuch froad kiya gya hai tab aap ko problems hogi.
Vashiyat par aap ke dada ji ke signature real hai to koi worry nhi hai.

A.Usually this property matter especially in relation to will this kind of allegation are common so you do not need to worry much if your father is otherwise not involved in forgery. Since this cases are determined by experts who can testify if the signature that is purportedly being alleged to be false is correct or not so the fate of such cases essentially lies on the testimony and other evidence that the parties will produce before the court in order to help the court adjudicate the contesting claims of the parties. The burden of proof will initially be on your aunt to discharge and if your father is clean then she will not succeed in her nefarious claim. The registration can only be done after the court adjudicate in this matter.
