Hi,
I had a cheque return case against one person inthe sessions court. But when it brought in the Adalat conducted by the Legal Services cell he assured me that he will pay in 4 equal installments in 5 months.but so far he has not paid a single paisa. The date was over and when I told him that I am moving to the court he promised that he will pay as early as possible, thinking of his family i didn't moved to court but still he didn't paid anything its almost more than 3 years over. after this he purchased a new property with 2 storied house worth 45 lakhs.Can i again move to court against him, is there any time limit for filling case after his promise in Adalat

A.Hello Sir.
As per Negotiable Instruments Act, legal notice must be sent within 30 days from the date of cheque bounce. Thereafter within 15+30=45 days from the date of sending the legal notice, case must be filed. In case the case is filed beyound that time then the same shall be time barred.

A.Hello
As per Negotiable Instruments Act, legal notice must be sent within 30 days from the date of cheque bounce. Thereafter within 15+30=45 days from the date of sending the legal notice, case must be filed. In case the case is filed beyound that time then the same shall be time barred.

A.Details are required to be examined. Was there any settlement recorded lok Adalat conducted by legal services cell? Was any decree or order was passed on the basis of your agreement with the person? Details required to suggest remedy.
