Hello, i have a 2 Bhk flat in Bangalore. I want to gift this property to my 3 yr old neice as my sister got divorced recently and i want to secure her daughter future. May i know what is the procedure and also complete list of charges involved

A.Hi,
You can execute a gift deed in her favor. Please note that the gift deed should be signed by a minimum of two witnesses and it has to be registered. Please contact a lawyer for further legal advice.

A.Hi,
You can execute a gift deed in her favor and get the property transferred to her. It is important to register the gift deed after the execution and it must be attested by at least 2 witnesses.

A.Since your neice is minor so your sister is required firstly to be get appointed guardian if child from court if law and only thereafter, you can gift your flat to neice through her guardian and guardian shall receive the gift for her ward I e. your neice. Since your neice is minor hence she cannot independently take or receive your gift. A proper gift deed is required to be executed by you with guardian of your neice which shall ve duly registered with registrar and thereafter few mandatory rituals are also required to be performed to complete the gift.

A.As your niece is minor and as your sister got Divorce recently,therefore, she will be considered as the natural guardian of that child( as her age is below 5 years) until and unless the Court decides anything to the contrary. Through registered Deed of Gift when you will gift the property to your niece,that gift has to be accepted by the natural guardian of your niece. After attaining 18 years,your niece will become entitled to her Ownership right in respect of that Gifted Flat.
