We want mutual divorce but my husband lawyer said the alimony amount would be pay in installments on the day of filing after signing the papers he said will bank transfer 50% of alimony, 40% of alimony will pay after counselling by cheque and 10% of alimony will pay through bank transfer.. kindly, guide me on this what if they don't pay me the alimony as per said?

A.Dear Sir,
Until entire amount is received he should not agree for giving verdict on mutual divorce. Never accept cheque which may dishonored.

A.Hi,
It is your right to get the alimony. If payments are not made in time, there are consequences; the court can take further action against your husband, such as penalties and it will also amount to civil contempt of court.

A.Please take note that until and unless you get the entire alimony prior to evidence, then you can be deprived and for which you will have to take judicial resort again. Being a matrimonial lawyer, I will advise you not to participate in evidence, until and unless your Streedhan return and alimony are completed.

A.Part payment plan is not advisable. Ask him to make all the payments in the accounts department of the concerned Family Court upon signing the divorce Petition and filing the same. The amount can be later withdrawn by you after the decree of divorce has been passed with the order of the Court. Especially the final part of accepting payments in cash is at all not recommended. Thank you.
