We have 11 acres inherited land for 2 siblings together. For income tax purpose, my sister has transferred around 50 lakhs over a period of 5 years and was mentioned as gift in my income tax affidavit.Actyally it was my money itself transferred from her account to show as white money. Can she now claim against me against dividing land by falsely saying that she has transferred money for complete rights of land?

A.Dear Client,
If the gift made is conditional that lets her claim back after a period of time, then it will have to be obeyed. Secondly, she can not claim against the division of land by falsely saying that she has transferred money so that you have surrendered the rights of the land unless there is an agreement specifically stating this.

A.It is necessary to scrutinize the concerned Affidavit to find out whether it was unconditional or not. If such gift was not unconditional, then Your sister can ask you to execute registered Transfer Deed transferring your property share in her favour.
