What is the stamp duty charges while filing case under section 138 in Maharashtra .What would be charges if cheque amount is 1 Lakh?

It is a criminal case as such no court fee and stamp duty will attract except advocate fees.

A.Dear Client,
The stamp duty required when case is filed under Section 138 in Maharashtra IS 2% subject maximum to 1,50,000. So for amount of 1 Lakh you have to pay Rs. 2000 as charges in form stamp duty.

A.It will be Court fees of 2% of the cheque amount which is Rs 2000 in your case. It is for 138 Negotiable Instrument Act Case applicable in Maharashtra and probably in other parts of India too as it is central legislation.
