I am buying a Resale flat in Mumbai. Society has not been formed yet. Seller has requested me to pay the amount since it is 2 years advance charges for society maintenance. I wanted to know if this pending payment is to be done by Seller or Buyer.
FYI, In the old agreement, it says " Society charges of Rs.X lakhs has to be paid by purchaser before or at the time of possession".

Please suggest.

Whatever is pending till the date of transaction will/should be paid by the seller as they are pre-existing liabilities and after the sale is done then you need to pay as per the applicable charges. Also the as per the old agreement the seller is supposed to pay the same.
