Sir
My husband filed divorce case against me. I am here alone in this city. Now I want to go my native place and will raise my child alone. He is not at home since 30 days. Can I take all domestic utilities like tv, fridge, washing machine etc. whether bought by him after marriage? If he comes to stop me than wht should I do?

A.Dear client , Since your husband is not responding any ways or you have no knowledge of his whereabout, you should file FIR fir his trace stating before thana incharge.
If he comes back then resolve issue amicably. If he still absconded then you may take all articles with you, bcz you hav your child who has right in property of father since birth. Or
You can also give notice in local news paper about his coming back , wait 15 days or a month, then take with all Articles with you.

A.No you can't take these utilities without consent of your husband. If he want divorce then you can ask for maintenance from your husband for you and child.hire family lawyer for filing maintenance suit. approach to vidhikarya lawyers for filing suit.

A.No you can't without his consent. those properties are his properties and not yours and neither it was gifted to you during or after marriage by friends and relatives as stridhan.

TAKING ANY SUCH ARTICLES WITHOUT HIS CONSENT WOULD ABOUT TO CRIMINAL BREACH OF TRUST AND THEFT.

It's better you contest the matter and ask your lawyer to file a petition for maintenance for yourself and for your child. If you don't contest the divorce case, ex parte will be passed in favour of your husband. If you have difficulty in paying the lawyer's fees you can approach Free Legal Aid Service to take up your matter on pro bono basis. A lawyer will be allotted to you to take up your matter and you don't have to pay any lawyer's fees.

A.If it's sridaan then you have a right to take all your belongings with you.
