My maternal grand father bought some land 25 years back. His brothers filed a case against him asking for a share in the land. My maternal grand father has included my mother and her brother as defendants in the case stating that they have equal rights to the property and won the case. He died in 1995. Then, his brothers went to high court and recently withdrew the case via settlement. Now, my maternal uncle is not giving any land to my mother. What can we do get the share in the land bought by my maternal grand father?

A.As per the recent landmark judgement of the Supreme Court, a daughter (your mother) is entitled to get equal share in the property of her father. Since her brother is not giving her equal share in the property, she should now file a partition suit in the civil court. Court will decide the matter in your mother's favour. She is entitled to get equal share in the her father's property. For filing a partition suit, contact a local lawyer from Vidhikarya.
