Dear Sir / Mam,

we've booked flat (Dec-2019) at Neral from one of the top 'Builder & Developer' from Navi Mumbai.
Agreement for sale is done accordingly on Jun-20.
Till date we have paid 4.98 Lacs to builder + Stamp duty & registration fee.

Now due to two things we need to cancel this deal 1) my financial condition & 2) there is no work in progress on that side since last 9 to 10 month, (pls note HDFC BANK approved my loan initially but denied to disburse loan after seeing work site condition as it's completly stopped)

on 18-Dec-21 we went to his office and informed him about my financial condition, they verbally accepted requst without any written acknowlegement & after so many followup (msg, calls, Emails) they are saying (on call) that you need to wait for 6 to 7 months more for refund.

Please suggest what will be best next step to get my refund on soon as i am going through financial crises very badly,

can i send legal notice to them OR can i filed complaint in RERA.

please help.

A.Dear client
You should sent them a letter for cancellation in writing and then ask them to cancel buying of the flat. You should also look at the agreement's cancellation process and accordingly seek the cancellation. If they don't do so then send them a legal notice followed by a consumer case.

A.Dear Client,
Since, you are going through financial crisis you must solve that amicably, and must state your problems because by sending legal notice or complaining in RERA would be expensive and time taking process for you.

A.Dear Sir,
Since there is no progress in the construction as such you can claim refund by approaching RERA and never say that you are unable to pay remaining amount.
