I am the owner of flat below the terrace. I have grown medicinal plants in terrace Association removed stating as per by-laws, no one should grow plant in common area. I have told the association regarding the rule of Tamil Nadu that encourages and allows terrace garden. The association says no rule will bind and the bylaws will be supreme. All those who are voting against terrace gardens are the people who are the owners of flat not just below the terrace. What is the rule if the owner of the flat just below the terrace agrees for the terrace garden ? Inspite of this can the association refuses to keep the plants in the terrace?

Whatever you do on the commons areas or properties must be done in consent with the other owners and the association. Common areas belongs to all and one person should not act as per his/her wish. If there is greater good for all then you should propose to the association and get their approval for the same.
