Sir/Madam
My father married my mother in year 1969 and I born in 1970 and my sister in 1973. In February 1975 my mother left my father and both child for Mr X, In July 1975 she realised her wrong dicision and she came back. At that time she was 6month pregnant. And the child (boy) was born in November 1975. My father gave him his name in birth certificate.
In December 2022 my mother and in December 2021 father died. My father was a Government servant and my mother was house wife. And my father purchased all properties in my mother's name.
Now that boy is asking for equal rights. What can i do.
A.Dear Client
As per the facts which have been provided, if your mother has not made any will then property may get divided among all her children equally but you can consult an advocate and file a suit in this case.
Hope this clarifies your query and requirement.
Thank you.

A.After your mother's death without making and publishing any Will, her property has been devolved upon her three children, each having undivided one-third share therein and by legal heir declaration the names of those three children are required to be substituted in the Record of Rights in the place and stead of your deceased mother.

A.Dear Client
Your case is a bit complicated. since the child has been given your father's name and identity hence he will be considered as your brother and will have same rights as yours. You can establish the fact that he is not your real brother but then also his rights will not be diminished.
