We three brothers have been granted letter of administration after my fathers death for his flat. My father did not make any will. Now we are confused whether to transfer the flat in the name of all the three brothers or we can directly transfer the flat in the name of our younger brother on the basis of a registered gift deed in favour of our younger brother. We want to protect our your younger from any future litigation from our wives and children. Will the above procedure gave him full clear title of the flat so that he can live peacefully will any future trouble from ourside.

A.Dear Client
Letters of Administration is a certification from Court and allows the administrator to administer property of deceased. Letter of administration is sufficient for transfer of flat. You can directly transfer the property to your younger brother by a gift deed.

A.Dear sir you and your brother can directly execute a gift deed in respect of the share of your rights in that flat in favour of your younger brother only and get it registered from the competent property registrar office in your jurisdiction. Every thing must be clearly mentioned and stated about the inheritance of the said flat by you three brothers and how your father got the ownership of the flat.
