Illegal possession of farm land
We've purchased a farm land last year.
The previous owner has not returned a part of money to a person who was to purchase the same land before us, but somehow the deal didnt take place between them.
Now that person has taken illegal possession of a part of our land and put some poles marking the partition. We have all the legally registered documents after paying all the amount as decided.
How should we proceed to take action against him? Whom to approach?
Under which IPC codes, we can take action against him?
How can we claim compensation for the land we're not utilizing because of this illegal possession, which IPC codes?
A.Hello Sir,
As per the facts which had been provided, the concerned action which should be taken by you is that you can approach the police and file a complaint under section 441, 425 of IPC,i.e., Criminal Trespass and Mischief. Whereby you may also file a civil suit under section 5 of the Specific Relief Act,1963, and pray for a temporary or permanent injunction against the trespasser.
Hope this clarifies your query and requirement.
Thank you.
