I would like to know information regarding appeal for reducing alimony ordered by family court judge. Judge granted divorce and ordered to pay alimony of 5lakhs.should i pay 5lakhs alimony and after go for appealing or can i directly appeal high court for reducing alimony without paying?

A.You need to file an appeal application for reducing the amount of alimony ordered by the learned judge of the family court according to your eligibility. If the high court gets satisfied then you may not need to pay the amount of Rs. 5,00,000/- so must wait for the final judgement of the High Court. For the time being in force, you must pray for an order of stay against the impugned order of the learned judge of family court before the Hon'ble High Court while your appeal is pending.

A.Hello Sir!

As per the facts provided, you can file an application to reduce the amount of alimony in a higher court but while the case is pending the court can direct you to pay maintenance pendente lite, i.e., providing living expenses to the wife while the suit is pending.
