Dear sir

I have a flat in Greater Noida measuring approx 1960 sft. The Society used to levy 2/- per sqft charges till August 2021. However in August they conducted a society meeting and with only 15 members attending the meeting, they increased the maint charges to Rs.3/- per sqft which means an increase of almost 2000/- over the existing 4000/-.

Also we are a society with almost 150 flats but they passed the resolution with only 15 members attending as most of the members are serving Army Officers and posted at various locations, some are retired officers but not in Greater Noida so cannot attend such meetings at short notice especially with various Covid restrictions in place.

I would like to know can society pass such arbitrary increase of Maint Charges by 50% and that too with such a minimal attendance and without any accompanying increase of amenities which warrant such a whopping increase of maint charges.

A.If the majority of the flat owners accept the new maintainance charge as appropriate then you also have to adjust for the same but if it is vice versa then with the mass consent of the other flat owners you can consult with an advocate and send a legal notice to the members of the association who have passed such new charges on behalf of all such flat owners who did not agree the same.

A.Dear Client

As per the facts which have been provided, you can send a legal notice stating the resolution has been passed by very few members of the society and can ask to conduct the meeting again so that more flat owners attend the meeting this time. And if no response comes from there side then you can file a suit against this matter.
