My wife along with my children went to festival and her parents have stopped them and asking now for divorce and throwing false allegations on me that i have been harassing her. changed her mind completely.

A.Sir first of all if you are confident enough that your wife has been brain washed to file a divorce suit against you then since you are not agreeing to give her divorce then she cannot file mutual divorce, hence she will be forced to file a contested divorce suit against you based on false allegations against you. So you need to file a suit for restitution of conjugal rights against your wife before the court of Learned District Judge of your jurisdiction so that you get the order of the court for staying together and live a happy married life again and at the same time you need to contest the divorce case filed against you by your wife (If she have already filed the divorce case then only). So you need to consult a good advocate at earliest so that the game remains in your court. If your children are minor then you need to file a suit for custody of your children as well otherwise your wife may not allow you to visit or have your children's custody in future.

A.Dear Client

As per the facts which have been provided, in case you are not agreeing to the mutual consent divorce, then your spouse can file a petition under the grounds mentioned under Section 13(1) of the Hindu Marriage Act.
