Divorce on the ground of illicit relationship
2 years ago
My brother who got ,married on 29.11.21 doesn't want to stay with his wife as his wife is involved in an illicit relationship. But his wife is forcing him to stay together. In this case what my brother can do ?
A.Dear Sir,
Your brother has to get concreate evidence by approaching private detective agencies otherwise court cannot believe your version. Every alternative husband claiming that his wife is having affair. It is very hard to prove such allegations unless you have direct evidence.

A.Dear Client,
As per the facts which have been provided, your brother can file for divorce without mutual consent as per The Hindu Marriage Act, 1955 as having an illicit relationship post marriage is a strong ground for divorce.
Hope this clarifies your query and requirement.
Thank you.
