I own an apartment in a gated community in Bangalore, registered under KAOA act. The terrace area is common to all residents. In this scenario, who will bear the cost of fixing the water leakage/seepage, that occurs inside top floor houses, from the terrace floor and parapet walls, is being debated. Top floor owners or society? I saw in a few online websites that there had been judgements given by the courts directing the societies/association to take care of this. Which competent authority we can reach out to to get a clear direction for this issue without filing a court case? Whom to reach for clarification of this under KAOA act?

A.Dear Sir,
Normally, it is the association which has to bear the expenses to keep terrace in good condition. You may get issue a legal notice or approach Civil Court to redress your problem.

A.Dear Client
Any common area be it the club, lift or terrace has to be maintained by the society and they should take responsibility to take care of the leakage from the terrace. If they wish they can take it up legally with the builder.

A.Dear Client,

As per the facts mentioned, you may file a complaint under KOFA. KOFA regulates the process of promotion, construction, sale, management and transfer of the apartment.
