Do siblings get share of property or asset bought by the eldest sibling in an undivided/joint family
2 years ago
Let's assume if a family has 4 brothers and while none of them are married or have set up separate families, if the eldest of them purchases land or some other property with his earnings, do the other 3 brothers get a share in that property?
A.Dear Client,
If the self acquired properties of the eldest brother are concerned the other siblings will have no share in the same and the same will fall entirely to the share of his wife and children etc.

A.Dear Sir,
It depends upon various factors. The eldest sibling must prove that it was so purchased from his independent earnings otherwise it will be deemed that it was purchased from out of sources of income from joint family property.

A.During lifetime of that property owner, his siblings are not entitled to claim any share therein. It is necessary to know whether that property owner is alive and whether his mother is alive.
