Sale agreement advance recovery

I planned to buy a house property after my home loan sanctioned and as per bank requirement I made sale agreement and made advance payment but finally registration couldnt happen because of there is case is open on the land survey number which we come to know in registration office record. Bank also advised not to buy litigation property. Now how I can recover my advance amount which I paid to seller. Sale agreement validity is 3 months can I file suit before the sale agreement validity..since property has litigation issue
