सर मेरे पिताजी ने आज से 15 साल पहले एक जमीन अपना पैतृक घर बेच के खरीद था हम 2 भाई 2 बहन है। मैं पिछले 13 से बाहर रह कर नौकरी करके सारा पैसा पिताजी को दे रहा हु जिससे पिताजी ने 1 बहन की शादी और उस जमीन में 4 कमरो के मकान का निर्माण किया मेरा छोटा भाई भी तभी से ही बाहर है और उसने बाहर ही किसी शादी सुदा औरत से जिसके 2 बच्चे पहले से ही थे शादी कर ली थी और उसने कभी भी घर मे 1 रुपए भी किसी को नही दिया
मेरी शादी दिसम्बर 2020 में हुई थी अब मेरे पिताजी उस मकान को बेच कर सारा रुपया छोटे भाई को देना चाहते है में क्या करु कृपया मार्गदर्शन करे
हमारे एक रहने का मकान ही है और कोई प्रोपर्टी नही है अगर वो भी बेच दिया तो सब रास्ते मे आ जाएंगे

A.Dear Client,

As per the facts mentioned, first you must prove that the property bought by your father was from the money he earned by selling the ancestral property, then you can file for your claim in the ancestral property share in the civil court.

A.Dear Client
The house which was built by your father (although you paid the money for the same) will be considered as his self acquired property. What you have to do is to prove that the land was bought after selling the ancestral property hence this house altogether cannot be considered as self acquired property and you have some share in that.
File a case for partition in the local civil court.
