Release deed on ancestral property
My sister was challenged for the partition of Ancestral property of 2 acres now, she got married in 1976 and my father registered a release deed in my favour in 1995 stating he got 25k money from me and released the property. According to the Hindu succession act, a married daughter before 2005 had no rights on Ancestral property also the release deed was given by my father to me before his death. He died in 2000. Please advice.
A.Dear Client,
release deed can be challenged by the legal heirs after the death of the person who issued it. married daughters are also legal heirs to the property and she can claim the property any time during her father's lifetime or even after his death. but you can show the proofs that the release deed was issued after you paid the 25k money to your father.
