Grandfather property partitioned, Do i have a claim?
Hi Sir/Madam,
My grandfather bought a property of nearly 7000 sqft and died without making any will on that property. Grandfather had 2 sons and 1 daughter. The elder son died leaving his wife and a son. My father is alive and has one son(me). Last month my father and my uncles wife and son signed and gave the property mentioned above to my aunt(daughter of my grandfather).. Do I have any claim in the property.?? Is there a way I can get the part of the property belonging to my father back??

A.If your grandfather has acquired the ancestral property then you have a right to claim, if such property was self-acquired by your grandfather then you have no right.

A.Dear client you need to go through property lawyer for challenging that property partition deed. But your right on that property will be secured if that property would be ancestral.

A.If you are a Hindu, you can try to challenge the release deed and ask for partition based on a claim the said property of your grandfather was not his absolute property but coparcenary or anestral in nature. The chances of winning the case cannot be stated.
