Divorce - Can a spouse deny for divorce
Can a spouse deny for divorce in front of the judge on the last day of judgment after agreeing for divorce with mutual consent for all throughout the 6 months of procedure? If yes, what happens in such case?
A.Dear client, The High Court has observed that the spouse who has given consent to a petition for divorce cannot unilaterally withdraw the consent and such withdrawal however, would not take away the jurisdiction of the Court to dissolve the marriage by mutual consent, if the consent was otherwise free.
