Ancestors land dispute
3 acres of land bought by my grandfather and after his death property divided in 3 part among 2 son and grandmother,, now grandmother wants to give it one son and decided to write will on that,,
now/ after other son(my father/me) can we challenge that gift will, ?
on the ground of
1. that property was bought my grandfather nor by grandmother
2. If that my grandmother gift's her share by his husband ( my grandfather) than will be our share on grandfather property 33% and my uncle (my father younger brother) share Will be 66%,
*
3. can we claim that property have main road approach,, (because they given us 33% property which far behind from main road and not suitable for any commercial establish,, remaing 2 acre of land have approximately 160 meter of main road approach but our share don't have any road approaching, )
Once the ancestral property is divided/partitioned among the legal heirs then the property received becomes the self acquired property in the hands of the receiver. So, your grandmother can do whatever she wants to do with the property.
As far as approach road is concerned you can seek your rights for easement.
