Namste mera nam pankaj kumar s/of anil kumar sir m janna chahta hu ki , mere pita ji k bde bhai yogendra prasad jinki deth ho gyi h or unka n hi koi barish h nhi patni or pita sirf bhai or mata ji h sir meri dadi ji chahti h ki unke beta yani mere tau ji jinki deth ho gyi h unki property apne nam krana chahti kuch logo se ray li h to sab bolte h ki property teeno beto m brabar btegi sirf mere pita ji hi chahte h ki property mata ji k nam ho jaye sir or bhai nhi chahte, sir esa koi rules ho jisse property meri dadi ji k nam ho jaye; please sir jo bhi solution ho use ditel m bataye aapki ati krpa hogi

A.dear client kindly go through property lawyer for filing suit of partition. besides this all legal heirs are have equal right on that property.

A.The property of the male Hindu dying intestate shall devolve in the following manner:-
1. Firstly upon all the heirs, being the relatives specified in Class 1(one share each)
2. Secondly if there is no heir in Class 1 then upon heirs being relatives specified in Class II
3. Thirdly if there is no heir of any of the classes, then the property is divided among Agnates (descendant or akin through male’s side) and then among Cognates (blood relative or descended from a common maternal ancestor.)

CLASS 1 HEIRS
Son
Daughter
Widow
Mother
Son of a predeceased son
Daughter of predeceased son
Widow of predeceased son
Son of a predeceased daughter
Daughter of predeceased daughter
Son of predeceased so of predeceased son
Daughter of predeceased son of a predeceased son
Widow of predeceased son of a predeceased son

Class II Heirs –
The father of the intestate
The intestate’s grand-parents and the grand-children
The brother or sister of the deceased
Other relatives such as father’s brother/sister, mother’s
brother/sister, brother’s widow/son/daughter or sister’s
son/daughter, etc.
