Hello
There was a dispute with my younger brother before 2.5 months. My brother was always arrogant and demands for partition due to his love marriage. after marriage he scold my parents , me and my wife. Also he tried to hit me and at that time my parents were present. then i told my father to please divide among us. before 2 month my father was ready and he kept one undertaking with the presence of my uncle, Now he is not ready for divison among us. He is saying to lets wait for next 2 to 3 years. but i am not ready to live with joint. i want to keep my parents with me if they are ready for it. Actually may parents may be guess the same situation . that why they made a 2 star house for us. in first floor my family and parents live and in second floor my brothers family live. but kitchen is one for all. so i think for quick solution the kitchen should be separate first. but my parent is not ready for that also, how to solve this?

Information is not clear. Firstly you must tell whether property under dispute is self acquire property of your father or ancestral. If it is self acquired of your father then there is no need to give share to your arrogant brother and your father can ask him to live separately on his own can alienate his self acquired property at his will. Secondly, what is the financial condition of you, your brother and father and mother. Whether they economically sound can live separately. Thirdly, whether your family is a traditional family, that is to say your father and mother cannot live without you both. If disputed property is an ancestral property then any one of you can file a civil suit for partition of property and get one share each and court can divide and give every one of you three a share in it. You must furnish correct particulars. Take expert advice of our advocates by furnishing full particulars.
Get file a suit for partition and make your parents and your younger brother as defendants. If your younger brother did not turn up the decree will be passed as per the terms agreed by your father. If your younger brother appears also there will no issue.
