I was cheated by one lady, she took 2.50 lakhs from me to buy a land on sharing basis, and she give two cheques to me, after money received by her she is ignoring me and not attending my calls, in that moment i come to know i was loose my money. later i deposited those cheques in her respective bank but those got bounced. now i need to file a case against her @10lkhs. an also i gave a complaint against her on local police station. now i need to processed how ?

A.Dear Sir,
First you must confirm that in the Police complaint also you have mentioned that cheque is for Rs.10 Lakhs because you have given only Rs.2.5 Lakhs and claiming Rs.10 Lakhs.

A.Dear client,
1) First of all send a legal notice to the absconder at the address you know. If the notice returns, proceed to file a case against him in the court. If you are able to substantiate money has been given to your friend either through documents or otherwise, you can file a suit for Recovery against the person in a civil court.
2) As the cheques have bounced, you can file a case under section 138 of the Negotiable Instrument Act, within 30 days of the cheque bounce date.
3) You can also file a case under section 420 of IPC for cheating. Cheating case cannot be compromised in courts as 420 IPC is not compoundable. Generally, accused pays up the money before the trial starts in order to avoid going to jail. So you need to ensure that the trial has commenced at the very earliest.
