I got remarried to an NRI a year ago. Lived only 2 months with him. He didn’t come back to india or take me to. Came to know he is a sex addict and has relationship with many ladies whom he introduced to me as “like my sister” and “like my daughter “. I have proof in hand. Didn’t support me financially too. Had told his friends that he won’t live with me but won’t give me divorce too. I lost a piece of land because of this guy to my ex. I lost my job during Covid and I am financially down. Please advise as how I can get divorce from this guy with compensation. He had been very cruel to me during my stay with him.

A.Dear Client,

You can file for divorce on the grounds of adultery under Under Section 13(1)(i) of Hindu Marriage Act, 1955. If you got married under special marriage act you can file a divorce under Under Section 27(1)(a). You can also file a petition for cruelty and file for maintenance under section 125 of CrPC. Please consult a lawyer near you to clarify your further doubts and to understand how to proceed legally.

A.Dear Client
You can file a case for divorce only after expiry of one year from the marriage. You can take the ground of cruelty for dissolution of marriage and as far as compensation is considered you can file a case for alimony or else maintenance case to seek maintenance on monthly basis.
