Can I file a caveat in high court for a civil case decided by session court in my favour(defendent) concerning a property? Further, I would like to know whether taking a Caveat will protect me from the other party seeking Stay for the property in question and then I have to wait till the first hearing, (that could be 3-6 months later) to respond? As I get to know that if I take a Caveat, before granting a Stay to the other party, I will get a hearing chance from High court?

A.dear client You can file a caveat U/s 148 (A) CPC 1908 as amended Act 104 of 1976

A.A.You can file a caveat U/s 148 (A) CPC 1908 as amended Act 104 of 1976.By taking caveat ,the court not to take any action or grant relief to the other side without giving notice to the caveator without affording opportunity of hearing.It is better to consult a Lawyer.
