Can Apartment owners association ask/collect unpaid maintenance amount which was due to builder and before formation of Apartment owners association

A.Dear Client,
The amount related to builder has to be paid to the builder. If there is no appartment owner association then you don't have pay to anybody.

Thanks Anik for your response. Want to elaborate the history and issue for better understanding.

The builder handed over the flat to us before 6-7 years . Initially the maintenance was taken care by the builder's appointed company only. Since, we had paid some lumpsum amount to builder at the time of purchase, they were deducting the maintenance charges from that lumpsum amount. After the lumpsum amount is fully used , they started raising maintenance bills on us. We had some issue with maintenance and we stopped paying to them . We have all the written communication available with us .

Fast forward, a association of owners was formed and maintenance is being done by the company managed by association. So builder's company is out and owner's association is in as far maintenance is concerned.

Now, we have received a notice from association for outstanding which was due to earlier company ( builder's appointed) . When we asked for clarification, they say that all the old outstanding has been transferred from builder's appointed company to newly formed association. so we have to pay the earlier amount to them. So the question is :

Do we need to pay the old amount to this association ? we have informed them that we are ready to pay the maintenance bills raised by association but not ready to pay the amount transferred by builder to them.

Request your advise. We want to go legal with this issue , do you think , it is worth ?
